1. Introduction

This Privacy Policy is aimed to inform you as a user of the Hydro+, and application distributed via application store(the “App”), collectively referred to as the “Service”, about collection, usage, sharing of Your information

By choosing to use our Service you should acknowledge the collection and use of information in relation to this Privacy Policy. If you do not agree with the terms of this Privacy Policy, you should not use our app. Your continued use of our app following the posting of changes to this Privacy Policy will mean that you accept those changes.

2. Medical services disclaimer

The contents of the App are provided for your information only. These Contents do not constitute professional medical advice, diagnoses, or treatment, and you should not rely on them as such. Your physician has particular medical knowledge about you and your health and should always be consulted if you have a medical emergency or questions about a medical condition. 

We cannot guarantee any health, weight and/or fitness results or improvements. Our Services are only intended for healthy adults, and please do not use our Services if you suffer from, or might suffer from, any medical condition that may be impaired by diet or exercise. Nutritional information found in our database has not been verified, investigated or reviewed by us. We cannot guarantee that the nutritional information provided in our database is accurate, reliant or complete. Hydro+ is not responsible for any personal injury or any other damages that may have been the result, direct or indirect, of any use or misuse of the Services.

3. Registration and eligibility

To use the App, you may be required to create or update an account and will be asked to provide certain personal information. You agree that you will supply accurate and complete information to the Company, and that you will update that information promptly after it changes.

To create an Account and access the App, you must be at least 18 years old and not barred from using the App under applicable law.

4. Usage Rules

You agree that your use of and conduct on the Services, shall be lawful and will not:

• resell, rent, lease, loan, distribute, or otherwise transfer rights to the App;
• include any offensive comments that are connected to race, national origin, gender, sexual preference or physical handicap;
• modify, reverse engineer, or disassemble the App;
• copy, adapt, alter, modify, translate, or create derivative works of the App without written authorization of the Company;
• attempt to impersonate any other party;
• permit other individuals to use the App, including but not limited to shared use via a network connection;
• circumvent or disable any technological features or measures in the App for protection of intellectual property rights;
• use the App in an attempt to, or in conjunction with, any device, program, or service designed to circumvent technological measures employed to control access to, or the rights in, a content file or other work protected by the copyright laws of any jurisdiction;
• use or access the App to compile data in a manner that is used or usable by a competitive product or service;
• use your Account to advertise, solicit, or transmit any commercial advertisements, including chain letters, junk e-mail or repetitive messages to anyone;
• use your Account to engage in any illegal conduct;
• upload to transmit any communications that infringe or violate the rights of any party;
• upload media of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, sexually explicit or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with this Agreement and the Company's Privacy Policy; or
• upload any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or this website.

5. Children's privacy

General age limitation. We are committed to protecting the privacy of children. This Service does not address anyone under the age of 18. We do not knowingly collect personally identifiable information from children under 18. If we discover that a child under 18 has provided us with Personal Information, we shall take steps to delete such information and terminate the child’s account. If you are aware of anyone under 18 using the App, please contact us so that we will be able to take the necessary actions.

6. Limited license to the App

This license does not allow you to use the service on any device that you do not own or rightfully control, and you may not distribute or make the service available over a network where it could be used by multiple devices at the same time. 

You may not rent, lease, lend, sell, redistribute or sub-license the Service. You may not copy, reverse engineer, disassemble, attempt to derive the source code of, modify or create derivative works of the App, any updates, or any part thereof. Any attempt to do so is a violation of our rights as a license. If you break this restriction, you may be subject to prosecution and damages.

7. Intellectual property

All intellectual property on the Service, which includes materials protected by copyright, trademark, or patent laws, is proprietary either to us or to third parties. All trademarks, service marks and trade names are owned, registered and/or licensed by us. All content offered by the service, including but not limited to text, software, scripts, code, designs, graphics, photos, sounds, music, videos, applications, interactive features and all other content is our intellectual property; all rights reserved.

By submitting User Material to Hydro+, you warrant and represent that you hold the copyright, trademark and/or other intellectual property rights to your content. You agree to grant Hydro+ a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use User Material to the extent necessary for Hydro+ to operate and maintain the Service. This license shall remain valid until the respective User Material is deleted from the Service by you or by Hydro+ in accordance with these Terms.

8. Subscription

Hydro+ IS A SUBSCRIPTION SERVICE THAT AUTOMATICALLY RENEWS. YOU MUST AFFIRMATIVELY CANCEL A SUBSCRIPTION TO AVOID BEING CHARGED AS DESCRIBED FURTHER BELOW.

The App is free to download. However, certain features of the Service are offered on a subscription basis for a fee. You will pay the App Store/Google Play the applicable fees as they become due.

You authorize the App Store/Google Play to charge the applicable fees to the payment card that You submit.

If you select to purchase products or services on or through the Service, or to use paid aspects of the Service, you agree to the applicable pricing and payment terms, as we may update them from time to time. Hydro+ may add new products and services for additional fees and charges, or amend fees and charges for existing products and services, at any time in its sole discretion. Any increased fees will apply solely on a forward-looking basis beginning on your next billing period. The subscription fee will be billed at the beginning of the paying portion of your subscription and at regular intervals thereafter equal to the length of your subscription unless and until you cancel your subscription. Subscription fees are earned upon payment. We reserve the right to change the timing of our billing, including but not limited to if your payment method has been rejected or is otherwise not successfully settled. Your renewal date may change due to changes in your subscription.

YOU ACKNOWLEDGE THAT YOUR SUBSCRIPTION IS SUBJECT TO AUTOMATIC RENEWALS AND YOU HEREBY CONSENT TO AND ACCEPT RESPONSIBILITY FOR ALL RECURRING CHARGES TO YOUR APPLICABLE PAYMENT BASED ON THIS AUTOMATIC RENEWAL FEATURE WITHOUT FURTHER AUTHORIZATION FROM YOU AND WITHOUT FURTHER NOTICE EXCEPT AS REQUIRED BY LAW. YOU FURTHER ACKNOWLEDGE THAT THE AMOUNT OF THE RECURRING CHARGE MAY CHANGE IF APPLICABLE TAX RATES CHANGE OR IF THE FEES HAVE BEEN INCREASED.

Certain subscription offerings may offer a free trial prior to charging your payment method, the period of which will be communicated to you via the Service. If you decide to unsubscribe from such a subscription before we starts charging your payment method, you must cancel the subscription before the free trial ends. Otherwise, you will be responsible for payment for the full term of the subscription period.

9. Disclaimer and limitation of liability

You use the Service at your own risk. The Service is provided “AS IS,” without any warranties, and Hydro+ does not warrant that the Service and availability thereof will be uninterrupted or error- free. Hydro+ does not assume any responsibility for errors or omissions in the information or software or other documents, including User Material, which is referenced by or linked to.References or links to third parties ’websites are provided "AS IS", without warranty of any kind, either express or implied.

In no event shall Hydro+ be liable for any indirect or consequential damages, except in cases of intentional misconduct or gross negligence. To the maximum extent permitted under applicable law, Hydro+'s aggregated liability for any direct damages shall be limited to the lesser of: (i) membership fees paid by the user; (ii) membership fees paid by the user during the previous calendar year; or (iii) 5,000 HKD.

10. Limitation of Our Liability

Your use of the Services and the content of the Services is at your own risk. We have no liability whatsoever for your use or reliance on any product or service you use or encounter on App. You are agreeing that Hydro+ is not liable under any theory of law for any compensatory, indirect, special, incidental, punitive or consequential damages, including but not limited loss of profits, business interruption, loss of information or data, a failure to conceive or deliver, failure to predict your cycles, any information or advice found on our site or in App, or any aspect of your relationship with a spouse, partner, or other third party. We would not be provided without these limitations and if you do not agree to these limitations, please do not use the Services.

11. Enforcement rights

We are not obligated to monitor access or use of the App, however, we reserve the right to do so for purposes of operating and maintaining the App, ensuring your compliance with this Agreement, and complying with applicable legal requirements. We may disclose unlawful conduct to law enforcement authorities; and pursuant to valid legal process, we may cooperate with law enforcement authorities to prosecute users who violate the law. We reserve the right to remove or disable any content posted to the App or access to App at any time and without notice, and at our sole discretion, if we determine in our sole discretion that your content or use of the App is objectionable or in violation this Agreement.

The Company has no liability or responsibility to users of the App or any other person or entity for performance or nonperformance of the aforementioned activities.

You agree to defend, indemnify, and hold the Company, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of this Agreement.

12. Miscellaneous

For the sake of clarity, Hydro+ doesn’t undertake the obligation to monitor the contents of User Material.

You are not entitled to assign your rights and/or obligations under these Terms or use of the Service to any third party without Hydro+'s prior written consent. Hydro+ is entitled to assign its rights and/or obligations under these Terms.

Hydro+ reserves the right to refuse the Service to anyone for any reason at any time.
